E-Discovery Consulting

How Can I Help You (and Your Clients) Now?

Some examples of ways in which clients have been helped on real cases:

1. Review, analyze and explain relevant client information policies, data maps and IT infrastructure diagrams to identify potential cost savings

2. Review, report on, and if necessary, revise and reissue the Litigation Hold process including steps taken to identify potential sources of relevant ESI and maintain Chain of Custody

3. Work with your client’s IT Manager, Records Manager, HR Manager and other key managers (as needed) to ensure that identification and collection of ESI are being handled in a cost effective and defensible manner

4. Ensure all data collection, restoration, de-duplication, and processing is accomplished in a way that is compatible with industry standards, existing and emerging Rules of Practice

5. Provide extensive advice on the culling process to ensure that appropriate methodologies and tools are used to generate the best possible (and manageable) search results

6. Work with the legal team to plan and convene meaningful Meet and Confer conferences, whether in the sphere of Civil Litigation or Regulatory investigations (Martin has extensive experience working with the demands of securities and competition agencies)

7. Guide you and your client when working with service bureaus to ensure effective project outcomes

8. Provide accurate assessments of the time and cost needed to collect, process, review and produce large volumes of ESI

9. Advise you on best practices for strategically handling special issues such as cross-border litigation, multi-party actions, privacy and privilege, legacy applications, and how to apply cost-saving strategies such as sampling

10. Work with opposing counsel on a Protocol for the exchange of evidence in electronic form; negotiate with the judiciary regarding electronic trial setup and procedures
